    Paypal Help

I figured that all the forums I am a member of this would be the best one to seek advice and insight. I will TRY to keep the story short.

I had a set of Cusco Vancanza wagon coilovers that I removed from my Forester before I sold it because they buyer did not want the coilovers. The coilovers were about 20 months old and did not look the best cosmetically, due to being daily driven, but performed very well. They did not squeak, leak, clunk, etc...nothing. Brand new these coilovers are $2,500 and are special order from Japan. I sold them for $800 shipped which is a third of the price of a brand new set and Cusco offers parts to rebuild. The cost of new hardware, boots, and rubber bushing/mounts was only $145.

Since I no longer had a Forester, I listed the coilovers for sale. I had an individual who inquired about the condition of the coilovers. I told him the cosmetic condition and sent him pictures. While I was taking pictures I noticed that each of the boots on the front coilovers had a small tear, which I disclosed as well. He informed me that he wanted to make an offer even though the coilovers were not in that great of shape. He paid via PayPal. I sold him the coilovers and shipped them. A little over two weeks goes by and I get an email from him saying that he wanted his money back and did not want the coilovers that I lied about the condition. I told him that I did not lie and had the emails to prove it. He then replied by saying that the coilovers were not useable because they were completely messed up and somehow got further damaged. He informs me that the top hats were falling apart, bolts were broken, the shocks were leaking, and the shock boots were shredded. He then threatened with a PayPal claim. I then call PayPal because I am worried about a claim against me and receiving back a product that the buyer destroyed. I was assured by the claim specialist that I would be contacted for emails, pictures, and that the process takes atleast 30 days, I was also informed that the products had to be in the original condition that I shipped them in or they would not issue him a refund. I felt relieved to hear this.

An other week and a half goes by it is the day before the dispute gets automatically closed when he upgrades it to a complete claim. Within 15 minutes of receiving the email about the claim I get an other email from PayPal stating that I agreed to refund him all the money. I freak out because I did not agree to this. I call PayPal again. The dispute/claim specialist said that there must have been a mix up because that never happens in 15 minutes, that the process takes at least 30 days and they will contact me for more information.

4 days goes by and I get an other email saying that PayPal has decided to refund the buyer all the money. I call again and this time a different dispute specialist says that, that was the decision. I then ask about the time frame when I was informed it would be 30 days. He laughed and said it is never 30 days. I then ask about the product being in worse condition since the buyer destroyed it and that I would be losing a good deal of money because now I would not be able to re sell them, to which he replies, "That's too bad." I continue to ask why I was lied to by other specialist and what about seller protection. He replies that PayPal never protects sellers and that when you give PayPal access to your money they can do whatever they want with it and that they don't need your permission to take your money. I then tell the asshole that I am closing the accounts that are linked to my PayPal and will not put money into my account for them to refund. I have not accepted the coilovers from UPS but have until Friday to pick them up before they are returned to the buyer.

Sorry for such a long story just wanted to get everything out there.

    C/N
Sells a set of coilovers that can only be special ordered from Japan.
Fully discloses condition of coilovers to buyer and sends pictures.
Weeks go by and buyer wanted refund and extra money.
Buyer informs that he damaged coilovers and will make claim.
Paypal guy is an asshole and I close all accounts linked to Paypal.

Finally onto my questions. Since I closed my accounts that were linked with PayPal is there anything they can do to get the money? Can they somehow use this to hurt my credit? Can they legally come after me? If I pick up the parts from UPS would that be considered stealing, since I am not refunding the money?

Help, as I don't have the money because I am paying off a large student loan in order to purchase a house and don't need anything negative on my credit.

I only read your cliff notes (thanks for that!) but I think that sums it up pretty well.

I'm not certain, but I don't believe PayPal can hurt your credit. They aren't loaning you money.

You are welcome on the cliff notes. Figured it would help the people out that didn't want to read the whole long spiel.

That is what I was thinking since it was not a loan. However I didn't know if they could somehow send it to a collections agency.

They may be able to hire a collections agency... but you can just ignore them. Eventually, they'll stop.

Uhh when you talked to that last guy I would have spoken to a supervisor. Total prick who obviously didn't care about the proper procedure for this incident or servicing the customer.

Oh and collection agencies CAN wreck your credit.

              Can they?

I dunno. Maybe Paypal can't get an agency on you, then. Like I said initially... they didn't loan you money. The guy that filed the dispute didn't get any money out of them, as long as you had no money in your account. The only person "owed" money (in quotes because it sounds like he's full of shit) is the buyer.

Do you have records of the guy's interactions with you? Emails or copies of your listing that show where you described the condition, emails that show his admission to messing something up, etc...?

I would definitely contact Paypal and complain about that guy. Give them the time of day and the phone number, and they may even have it recorded. If not, they'll at least be able to identify who he is.

The dude bought used stuff, as-is... and his complaint came after he messed with it, not when he opened the box.

i have a buddy that went thru several paypal accounts and he owes money on all of them and as far as i know they never reported anything to bureaus and he never got calls from any debt collectors so my statement stands unless procedure as changed recently.

Paypal can sent it to a collection agency and sometimes they do.. Than it will hurt your credit.

None ebay and Paypal side with the buyer 100%.. As a seller you can get screwed over real easy now.

Put it this way... They sided with the buyer.. They paid him . They expect to get paid by you... Id ignore them but just know you are risking your credit.

BTW pick up the coilovers you are screwed either way... Sell them for your trouble.

I did complain but the person at PayPal said it wasn't sufficient. I wish I had kept the emails but I stupidly deleted a lot of them. There was a two week period where he said nothing to me so I figured he changed his mind to keep them.

I know collections agencies can hurt my credit but I just don't know how exactly they work. If PayPal decides to give this guy money that is on them since I didn't agree to it. I just don't know how they can turn it in to a collections agency since it wasn't a loan or service?

I got an email last Monday that the money was going to be refunded within in 3 days since I refused the package from UPS. However UPS sent me a postcard saying that I had until a certain date to accept the package before it went back to the sender. I don't want him to get the parts/money and then PayPal somehow comes after me for money and I'm out everything.

Pick up the package... Its not "on them".. Its in the contract you agreed to that no ones reads when you signed up... They can send you to collections.. I know someone they have sent to collections for something like this... But chances are good you just wont be able to have a Paypal account anymore.

I just went and read PayPal's user agreement and there is a small line in like the 10th paragraph of a some section that states if you have a negative balance you need to add funds immediately or PayPal may choose to send it to collections.

Will I be contacted before there is chance for it to effect my credit?

I haven't heard anything from PayPal for a week about anything and my account obviously is still negative.

What was the amount? In the little searching I did it seems they only take people to collections for amounts over $1,500.

This is why i dont have a paypal account anymore. I got scammed out of three hundred bucks back in the day after selling a bunch of video games. The guy said he never received them so paypal sent me to an a collection agency to reclaim that money.

Thats kind of lame that a company would protect the buyers and not the sellers. Without the sellers, there would be no company.

they wont' do anything. i had to file a claim against good old billy, he said he shipped, i never got anything, either way i was out $300 and he wouldn't issue a refund. i filed a claim, the said "you win", took the money from his account and never gave me jack shit.

no, it won't affect your credit at all, it will affect your paypal customer rating but that's useless

and billy isn't that guy above me, billy sold me car parts via paypal and then never shipped, he was just generally full of shit
....and on the 7th day, deevergote rested and called his mom.

I got screwed out of $80 the exact same way. In fact, my dispute is still open, waiting for the dude to get money in his account (it's been 5 years... not happening.)

                              whazzup fizzy?
