traffic court on jun 3rd... help.

ok guys, i would like your input here. any that might help me win the case.

couple months back i got a ticket for modified exhaust and suspension. the cop that gave me the ticket marked "correctable" on both violations... so i got them written off by a cop. i got my slip from the traffic court saying the violations are NOT correctable and i owe $256.

i goto the court and show them the citation from the cop and that he marked correctable... i gave her my sob story about how i spent the money correcting the problems because the cop told me i could, and then get them written off. all i get from the clerk is... well they might have been correctable in the past, but not anymore. then she just says i can take it in front of the judge and see what he says.

has anyone experienced anything like this in the past? especially you cali people, since our laws seem to be some of the more strict. im thinkin theyre just gonna say, oh well... the cop fucked up. maybe its just bad karma coming to bite me in the ass since i never really fixed anything...

its different in each case...all depends on the judge...i got a ticket for loud speakers..(stupid ass mofo cop)...judge told me to pay 180 and its a 1st offense....few weeks later my friend got cought speeding 20 miles over the limit...judge told him to pay...125....and its his 1st time...so yeah..this is a perfect example of it...
    So SIIC...

    SoCal OG bitches...

He's right, it's a different situation depending on the judge/day/weather. I'm not even kidding, you gotta wonder sometimes why lady justice's eyes are covered. Makes you think, how the system can be corrupt yet effective. I just paid my ticket for my tint, no fix it, just a violation. I could keep paying these forever, but I'm just gonna remove it eventually. Good Luck, be humble, apologetic to a certain degree. Wear something nice, don't look like a punk (not that you do, just helps if your nerdy/clean looking). That's my personal opinion, just from seeing/sitting in traffic court on more than one occasion.

actually it is on a friday. and dress clean... damn!!! its gonna be hot, i wanted to wear shorts and flipflops. oh well, small price to pay to hopefully get it reduced.

if they wont reduce it, is there any way i can fight the suspension ticket? the cop never mentioned that my car was low. he said the susp was too ridged... like it needs to bounce up and down when pushed on, like a stock setup. is it even worth trying to reason with the judge that my suspension is safer than a stock setup?

also, he had no reason to check my suspension. he was just writing my ticket for the exhaust, he pauses for a second... takes a couple steps back, walks to the front of my car and pushes down on my fender. then he just says i cant have that either.
when he first saw my car i was at a traffic light, then i was cruising between cars doing maybe 20mph... so he has no idea how my suspension performs. does he still have the right to just do shit like that? its so obvious he was just looking for anything. when he pulled me over he said nothing about my car being low or anything related to suspension.

Do what I do when I get stupid tickets , have them push the court date further

I got pulled over for having a blue licence plate cover and then they gave me a ticket because i couldnt find my licence..

a YEAR later my court date came up , went to court and when it was my turn to go up..

to be a pain in the ass and cost the courts some money i told them i would like to push the date back and the reason was to get DISCLOSURE thats the key word..

so 5 months after i came in and the lady that ticketed me didnt show up so they had no choice but to throw the ticket out and i got off free

yea ive checked before. he's trying to get me on vagueness. the actual code he wrote for my suspension was for an "unsafe vehicle"... but says nothing specificly relating to suspension height or stiffness.

yeah the only illegal suspension ive ever heard of is when your car is so low that your headlights are at an illegal height. i guess your headlights need to be "so high" to meet regulations

i wouldnt keep pushing the date back.

just go to court, cops right tickets cops can right off tickets and you have proof of that. the judge is there to make the final decision. wear something nice and go to court!

did you really get your exhaust fixed? if so show proof of that, take your car to honda and ask them if your suspension is unsafe and have them right up a little letter to the judge. thats what i would do. take proof! that it isnt unsafe.

who cares if the cop shows up, the judge will mess with him for writting on it that it was correctible, clerks dont know shit.

yea, thats the thing. i never got anything fixed. i have a friend that has some cop buddies that frequent his dads restaraunt. i was going to borrow a friends car before i go, cause if for some reason they do ask about my car, i can honestly say it isnt there. ill ask a friend to see if i can get a note. i know a few people that are honda techs.

God I love Florida! We don't have to worry about anything like that. Also I'd agree on what everyone else is saying, it really depends on who's there and who's not to see how things turns out. It may sound F'D up but that's how it iSSS

its true. i HATE clerks for the most part... b/c theyre usually miserable older ladies who obviously don't get laid enough for their own satisfaction and have to deal with other people's BS all day, so they take it out on the little guy....

...but seriously, dress nice and be honest - don't act like a know-it-all and don't smart off; even if you act "knowledgeable" they may see it as you being a smart ass, know what i mean? So yes, defend yourself, but of course choose your words wisely Take someone elses car if you want and say you were getting it fixed today or some other excuse -- "too stiff" is no reason to write a ticket"... and anyway, "too loose" is what's really unsafe... however standing on the roadside pushing your car is by NO MEANS a scientific, measurable way of testing a car's "stiffness" -- he's no mechanic, and you're not at an inspection station for yearly sticker... that cop is just grabbing at straws

know your rights under the law most importantly -- and if there's nothing they can do about something, make sure you make that clear in a professional manner ...

                          ...good luck

Yeah i would definatly get some of your tech friends to write something that sais your suspension isnt "unsafe"

another thing, if the cop gives you a ticket for something that is out of code, its his fault not yours.

i got bs ticket one time for speeding, the cop said i was going 10 over the limit, he was behind me the whole time. seriously who speeds infront of a cop? took him to court, and he asked me various questions, then he asked the cop for the certificate to the radar that showed it was calibrated. they usually have to be calibrated 2 a year i believe and the cop didnt have one so i got off. needless to say i wasnt even speeding at all.

OK, here's the thing on modified suspensions. He had no way of telling it was lowered by you or by the dealership, or even let's say it lowered over time by natural means. The only law I have heard of is, the car becomes hazardous if the headlights don't shine to a certain height/length. It's a bullshit violation, and that's CA for you. They have some of the most well trained cops in terms of import modification and violations. I would say to anyone that gets pulled over for an exhaust, you're pretty much f'ed and probably should change it anyway because your car is making excessive noise. For lowering, most laws are written in a way, that modifying anything on your vehicle that could cause harm to you or any person on the road is deemed illegal. So, if you did get pulled over, in court you would have to prove it is safe, as in BMW's come lowered using abc springs, and use the same brand. Something like that. Truth be told, most cops drive domestics, and give shit to import tuners because they know they can. Show them in court, we're not a bunch of ignorant bitches, and maybe things will eventually change. That's what I have done, and although nothing has come of it yet. @ least I know I stood up for my rights.
