eBay/UPS Issue... what does everything think???

i recently sold my old cell phone on ebay. someone purchased it and i sent it out via ups. i didnt offer and they didnt request extra insurance, so i left it blank, meaning it covers $100. the auction ended for $175. i sent it out, gave the guy the tracking#. he doesnt question that i sent it, but the package got "lost" by ups, so now the guy is emailing me, calling me saying i owe him the $175.

i told him basically, shit happens... but in a nicer way. i sent it out and he has proof of that, after that point i cant be held responsible for ups' mistake. does he have legal right to demand money from me?

he wants his money back from me, but where the hell is my phone!?!?!? i dont think i should be the one getting screwed in the end. and the saying goes... let the BUYER beware.

    whatchall think?

if he wanted insurance, he should have requested it. you did everything right by having a valid tracking # and notifying him of it; let UPS handle this problem.

Insurance isn't for the buyer, it's for the seller!

He bought a phone and paid for it. His end of the deal is done.
Your end of the deal is to get the phone in his hands. That's not going so well.

If UPS kicks up $100, get $75 of your own to even the deal.

If you don't think you should get screwed...well....why the heck should the buyer? He did nothing wrong.

Remember ,the buyer has the easy part of any deal. Paying is simple and fast. Delivering goods isn't, which is why you get insurance. He doesn't need it, his job ends when you accept payment.

NO!, if he said that insurance was not included in the auction and said that insurance was extra, then its the buyer's problem...insurance is extra and you must pay extra to get it...personally i would always be willing to get insurance on anything over 100 bucks.

just wait till UPS finds the package.

i thought UPS covers up to a certain amount anyways?

Not sure I understand...what is the buyers problem?

                    Package delivery certainly isn't.

Tracking number will reveal whether package has been delivered or not.

i understand what youre saying steveb... but why should hte buyer get screwed? are there any real rules when something like this happens? whenever ive purchased something on ebay, the buyer usually leaves an option for additional insurance if i choose to purchase it, if not, thats my bad.

by what youre saying(steveb). i can choose not to pay for insurance(say i just dont wanna pay the fees) and if my package doesnt arrive... complain to the seller and demand ALL my money back? that wouldnt be fair to the seller. if i did that, the seller would just tell me, too bad, you didnt pay for the insurance.

you said, the buyer's job is done once he pays... well the sellers job is done once he ships it out, and confirms shipment. i cant walk the package to the guys house, why should i be held responsible for what ups does with it. what if the package does make it to the guys house, but gets stolen off his front porch? am i still held repsonsible for his refund because he, personally, never got it?

                        buyers job=paying for it
                        sellers job=shipping/providing proof of shipment
                        shipping company job=delivering package

if the buyer wants to be fully reembursed for his loss, he needs to pay for insurance from ups to be covered.

thats like me getting into an accident with my "liability only" car, and demanding full coverage from the company. if i wanted full coverage i needed to pay for it.

Not once you have delivery confirmation from the shipper, no.

Anyhoo, give UPS some time to sort things.

its actually been about 3 weeks since it should have been delivered. ups called me about 2 weeks ago, said they put a trace on the package and should be calling me back within 8 business days... never got the call.
