    A warning!!!

THIS IS POSTED AT ACCORDTUNER.COM ALSO

    Ok, here is the deal.

A little while ago, I was surfing CB7tuner, and I found what I thought would be a good deal.

    the link:

    http://www.cb7tuner.com/vbb/showthre...&threadid=7710

Anyways, I get pumped, because I see that apparently the only thing wrong are some scratches, and a new paint job. So I pay the $416 dollars. It takes about a week for her to ship them. Ok, that's not too bad. So I come home from work, and I find them on my front porch. Stacked. They were not in boxes or anything. See, I would have paid extra for them to not just be thrown around.

So, I get them, and they are in completely horrible condition. I mean, I would take these things FREE. But, I put them on my car anyways, because I think that I can just wash them and get them painted. I notice that the tires are flat, and are about to explode. There are little bulges of air coming out all over the place. The tires are literally cracking open.

Now we get to the good part.

I take them to Goodyear to get them balanced. I come back, and they have a huge list of things wrong. Apparently the front wheel was SEVERELY BENT. Nowhere was I told that a rim was bent. Not in any emails, not on this forum, no where. They are also scratched. Not the paint, but the rim itself has deep grooves.

I've attatched a picture of the wheels.

So I email her and tell her the situation. Here are the email logs.

This is her reply to my email:

"sorry for the late reply, some thing went wrong just b4 I send the
    reply, so
if you didn't get the message before. Ill retype it. you say there a
    bend.
is it bad. I told all I know about it and I only knowdice the crub mark
    and
scartches. it use to be my bro's rim, but he getting gutmetal rim. I
    didn't
want it cause it's slower with the rim on. need to work on the engine.
    so
    what the deal now????"

    Looking like she may cooperate.

    My reply:
"The tires are completely bald on the inside and out. All of the tires need to be replaced. The rims are totally scratched, the paint is coming off on all of them, and one rim is SEVERELY bent. I can't drive with them on. It has already cost me $40 to get them balanced and to tell me that they are in horrible shape. Goodyear actually told me that I was ripped off. It'll cost me $400+ for new tires, $150+ to get the bend fixed and to get them looking decent. We need to work out an arrangement for me to get a refund and send the rims back. I was completely ripped off. Reply ASAP. "

    Her reply:

"You where not rip off. otherwise I wouldn't even sent it. I did what
    the
process do. tell you about it. give you pics. shipped it to you. If I
    rip
you off I would sent you nothing and other things. The rim are not
    perfect
due to the fact they are used. the paint is not coming off of all of
    them. I
know two rim are still good. except some tiny little scrathes. Tires I
    say
are 50% less left and the side were wearing out due to negative camber.
    It's
not bad like you say it is. GOODYEAR is acually ripping you off. tire
    are
not 400+. I found sets at discount tire and performace store for 300
straight. and bend don't cost 150+. They work for money and to profit
    from
you. Sorry, but I can't refund due to the fact that you own it now and
    I am
not responsible if it not what you like."

At this point, I get very angry.

    My reply:

"This is a blatant scam. Goodyear is not the one ripping me off, YOU are the one. Please show me WHERE you told me there was a severe bend in it. I have links and screenshots of the two posts at CB7Tuner, and AccordTuner where you tried to sell these. No where did you say there was a bend. In all of the emails, no where did you say there was a bend. It IS bad like I say it is. The tires were 400+ with labor. The $150 was for straightening the bend and painting it. http://www.wheelmedic.com/wm/index.htm then go to pricing if you don't believe me. The only place around me. I am including pics of ALL of the tires and wheels and the damage to them. I'm also going to scan and send you a copy of Goodyear AND Wheel Medic's analysis of the damage of the wheels. I'm going to go over all of my options for getting back my money from this scam."

    Her reply:

"I didn't say there was a bend because I didn't know. Yea I know two of
    the
rim don look good and that's all I could see. and the tire you show
    me?????
i rode on those tire. I could careless if a nail was in there, but
    haven't
gone deep enought. I could careless if it's looks like that, but you
    get
what you pay for. A set of RIM with TIRES. It's the deal. No my faul
    that it
not what you expected. Just like a used car or parts. it is what it is.
    I'm
saying these in a nice way. there are 17" tire that are 65 on some of
    the
import magazine with free shipping. so go look for that instead of that
400++++++deal. I'll tell you this. If I plan to scam you...I would lie
    about
it being perfect and make you pay and never send you the rim. so what I
    did
is a SCAM, but lie about being perfect and never sending you it is A
    Super
Deal. I don't know man. looking for perfection is immpossible! com on
    it use
and that the deal. all those little scrathes don even compare to a
    scratches
on a car. ..........????????!!!!!!!! later man."

Who is in the wrong here? Do I have a right to be angry?

Sorry about the long read, but please help me out. What are my options for getting a refund? DO I have options?

    Thanks
    Noah

if she/he didnt say "AS IS" then she/he should pay to the rim to get fixed... as for the tires...that really doesnt have anything to do with she/he...

u should get ur money back or make he/she pay to get them fixed...

ok if she/he sent them with out a box??.. theres no way in hell
they cant do that.. so sounds like to me they ran those rims in the ground(i.e total fucked them up) after u payed for them and then drop them off at ur house...

if they did ship them(duno how with out being in a box) get the trackin number and call the place they shiped them throw and find out what the fuck happen to the rims... it could be throw shipping but notlikey.. but its worth i try.. maybe they will pay for it..

then again no boxs= no shiped.. so if they are local i say go over there and fuck there shit make them pay the money back.. one way or another

Yeah, there were 4 wheels and tires laying on my front porch. By the way, what is throw shipping? Did you mean through?

I have the tracking numbers. Fed Ex shipped them.

And no, they are in Minneapolis (sp?) and I am in Ohio.

I appreciate the help by the way.

edit: no papers. I got screwed.

ok, bro, read the whole e-mail, and I read the post prior to this. I was in a similar situation myself but it had to do with my sisters ride. I was on a jetta forum, and made a similar deal in which she paid the seller for a hood that he listed as emaculate condition. When it arrived, it was FAR from the truth. Here's the problem with this, since you are going through emails, and no contract and/or receipt was made (correct me if im wrong), than all you have is an oral/email agreement. You could take her to court (it's more of an arbitrator, but that should scare her enough to get some money out of her.) Did she list it "AS/IS" at all, or during any part of your transactions? BEcause that is the only thing that could screw you. If you were mislead intentionally she is absolutely responsible and you can/will take her to court. I would let her know your rights, because honestly she's giving you the run around it seems. I ended up going to an arbitrator over the CF hood for my sisters car, and basically they ended up awarding my sister little bit less than half that she paid for damages to the hood that the seller never spoke of.

ANYWAY, I wouldn't be pissed because this is what it's like, people are assholes and almost no one can be trusted online. I'd threaten her, and make it sound "LEGALLY THREATENING", that should do the trick. After all, it is your right to do so. Buona Fortuna.

well there no way they shipped them with out boxs.. maybe sumhow the shippin co. droped them kicked them around or they fell off teh truck.. i duno its worth a shot

but make sure she/he shipped them with boxs(u HAVE too) if they were shipped in boxs and u didnt get them in boxs.. then the shipping co. is relable(sp?) for the rims

Could go both ways IMO, you did buy "used" rims and tires, but then again one is warped and she didnt tell you, but she really might not have known about it...

Tires def. dont cost $400, unless you wanna get the stickier rubber.

I like this part: ... it is A
                        Super
                        Deal
if she really believes she gave you a good deal-that obvisously says she ripped you off.
Then she goes on to say the 2 "perfect" rims have little scratches, so again it sounds like shes ripping you off.

It really sounds like these rims/tires where on a car that got totalled and shes trying to make up some money.

Def. do what you can to get your money back, this is a complete ripoff. It sucks when people cant give honest descriptions of the products their selling.

Wow, seriously, this help is awesome!

Ok, yeah, no boxes at all. Just tags attatched to the wheels that said fedex on them.

NO WHERE did it say AS/IS. She said that there were a few "little scratches." Seriously, you have to see these wheels in person. Worst condition.

As for the court thing..is it a problem that we are in different states?

What I don't get is how she didn't notice? The car shakes incredibly with the bent rim. No way could anyone have not noticed that.

Also, what I don't get is the part in the last email about the nail...what was that all about?
