    Got a ticket for....improper start????

The other day I was late and in a hurry turning right out of campus. Wide white road paint(road paint is slicker than the road itself) marks mixed with me in a hurry and popping the clutch while turning right produced a couple tires spinning for a second or two. A cop evidently was near and heard me and chased me down. I got a ticket, moving violation, for "Improper Start" costing $240 and requiring a court appearance. He wrote down South Carolina code section 56-5-2110 as the "rule I broke":

"SECTION 56-5-2110. Starting of a vehicle.

No person shall start a vehicle which is stopped, standing or parked unless and until such movement can be made with reasonable safety."

Anyone ever heard of this law applied for this reason? I'm thinking of requesting a jury trial and arguing that this law is completely misapplied to the situation. "Reasonable Safety" is VERY open to interpretation.....Any thoughts?

It's basically a law so they can ticket you for spinning tires and squaking them. Since while they are spinning you technically have a loss of traction which is technically loss of control which is technically dangerous...also it can be considered wreckless/aggressive driving.

I got one back in the day but I did a peel out from a stop light.

you can fight it...might be able to pull off accident but since you were in a hurry...they'll just say you were driving aggressively which is also illegal. Good luck

        That says it all . . .
I don't think the cop was unjustified in giving the ticket.

Just say that your feet was stuck at the clutch. I did that twice and the cop let me go. LOL

I've done the exact same thing over paint... especially when my tires are starting to wear out.

The citation is interesting... "starting" a car... your car was already started!

I think by "starting" they mean, starting it in motion.....

We have a similar law here. Its called "excessive rotation of tires" or "over-rotation of tires".

My dad missed his high school graduation due to something similar. He was at a park, not on school property, and it was a gravel lot, and as he left the lot, in his RWD MT car, he flung some rocks back and they hit a cop car. Well, the cop got all butthurt and said it was assault and he got charged with that. My dad swears he wasnt doing it on purpose, but who knows.

$240 seems a little steep too.

                    Thats about right.

You can try to fight it, but if you said anything to the cop about being in a hurry or admitted to spinning you tires in anyway you will be waisting your time. The cop will just pull the tape and show the jury the video of the stop and your done.

$240 seems real steep, but it will probably get cut in half if you just go to court and plead gulty.

My only concern with fighting it is if they decide to slap me with something worse (such as wreckless driving). I wonder if playing dumb like "my foot slipped off the clutch" or "my foot got stuck on the gas" would work. I fully admit that I spun the tires, but it WAS an honest accident, I wasn't trying to spin, it just happened because of several circumstances.....and $240 is very steep for me. I really think the officer sorta targeted me because of what I drive....I got that impression from him, but I would never mention that in court because I'm sure it wouldn't fly there.

                        this one could work!

how long has the car been insured under your name? or maybe you could state that you just did an auto to manual swap but then that may lead to a vehicle inspection... prob. not the best idea.

i don't know but if you can work an excuse around that it seems like a legitimate one.

its a pretty lame reason to get a ticket unless you were intentionally staying on the gas to peel out.

Go to court under any circumstance. Maybe the cop wont show up and it will be thrown out!
