    Hypothetical question

Just something here that crossed my mind

    Scenario 1

4 people are driving in a car, they are all under 21 ( but over 18 ). All 3 passengers are drunk but the driver is sober. They get pulled over and the cop notices and finds out they're under age. Would the driver get in trouble although he's sober?

Scenario 2 is identical but now the driver is 21

No, the driver in both cases gets off scott free for any alcohol offenses in both cases if he has not drank any alcohol or have any open containers in the vehicle. He might get ticketed for what ever initial reason he was pulled over for though.

Since there is no way to prove that the driver contributed to minors consuming the alcohol, then he is free from that.

As long as he is sober and thus able to drive the vehicle, then besides the traffic stop, he is good.

As far as I know (and hoe that it's true) what ^these ^ guys said is true. We have a sober driver for parties and we could have a whole car filled with drunks but as long as the driver is good and didn't do anything wrong to get pulled over, the police can't do anything. I've heard stories of people that got pulled over with like 7 drunk people (some in the trunk) but the cop didn't even give him a ticket for too many people because the driver was doing a good deed.

          1. Driver get's off scott free. Friends get alcohol related tickets.

          2. Driver gets hit with contributing to the delinquency of a minor and something like supplying to a minor.

Minor = underage person when used above

Of course, this is if the cop wants to be a dick. I was let off several times in both of your situations above.

unless the cop has proof that he supplied the alcohol to the minors, he cant give him a citation for that.. for all he knows, its an older brother/cousin/etc helping out some kids friends..

the minors would, of course, get underage drinking citations..

Alright thanks guys, I mainly asked this just because its a scenario I could see myself in in the near future. I just wanted to know what would happen before I got in trouble for some stupid shit.

In both cases the cop would normally let you go if your sober. But in scenario 2 you could get a ticket if the cop wants. But if your sober and driving drunk people most cops will forget about any tickets because your being responsible and helping out the intoxicated people.

Years ago, my girlfriend and her friends threw a party in a hotel. All participants were under 21. I was 22, I think. I was smart enough to stay away. I swung by once to give some people a ride home, and then I got called back when the cops shut it down (and at least one girl was puking her guts out.)
The cops looked at me accusingly, but I explained to them that I was only there to give a ride. The cop accepted that response and didn't hassle me one bit.
The father of the really drunk girl looked like he wanted to kill me, though. I almost knocked his ass out, because I had NOTHING to do with that party!

If a cop were to pull over a car full of drunk people, he might make the driver complete some field sobriety tests, just to be sure they're not impaired. If the driver is underage, it's possible that the cop would take him/her down to the station to take a breathalyzer test, since anyone under 21 years of age is guilty of driving under the influence even if their BAC is .01. ANY amount of alcohol in the system of a minor is considered "under the influence"

This thread makes me question how a cop would ever actually ticket someone for buying for minors.

Breathalyzers can be administered roadside. If he takes the driver downtown, then he has to deal with the drunk kids.

Usually it's the store that takes the hit for selling to minors, but im sure cops have seen it happen in front of them once or twice...

or if the kids give up the adult....

or if the adult is drinking with the kids...

Publicly intoxicated minors probably need to be dealt with anyway. If something were to happen, and the officer is on record letting those kids go... it'll be his ass.

I don't know if the roadside breathalyzer is admissable as far as the BAC goes, though. I believe a driver must undergo a period of observation at the station, and then be given the breathalyzer test under controlled circumstances. The field breathalyzers are more for determining a basic level of impairment (much like the other tests administered.)

                          That doesn't sound right.

If they let them sit and then test them, the bac will be off.

Im pretty sure the roadside test is admissable, as it's enough to arrest someone..

Being taken to the station is an arrest. If you can't stand on one foot, you get arrested.

Local newspaper has published police reports where by the time they got the guy to the station, he was under the legal limit and allowed to go.

                              Something like:
                              Roadside is 0.09
                              Station is 0.07
